OpenAI's HIPAA Implementation and Configuration Guide, posted July 9, 2026, says ChatGPT Free, Plus, Pro, and Business are not Eligible Services. Without a BAA on an eligible product, those chats are not a place for patient data.
The same guide names products that can be covered once a BAA is executed: ChatGPT for Healthcare, ChatGPT for Clinicians, ChatGPT Enterprise with a Regulated Workspace, and the API with Modified Retention. Those are healthcare or enterprise products, not the consumer chat.
