HIPAA-compliant AI

HIPAA-compliant AI is AI software that can lawfully process protected health information. That requires two things: the vendor signs a Business Associate Agreement (BAA), and the system runs on HIPAA-eligible infrastructure with appropriate safeguards. Without a signed BAA, using AI on real patient data is not compliant, regardless of the model.

What makes AI HIPAA-compliant

HIPAA-compliant AI is software that can legally handle protected health information. The non-negotiable requirement is a signed Business Associate Agreement between the practice (the covered entity) and the AI vendor (the business associate), plus HIPAA-eligible infrastructure and safeguards.

This is where most tools fall short: the AI itself may be capable, but the BAA is gated behind a paid or enterprise plan, or not offered at all. A free plan without a BAA can only demo on fake data; it cannot lawfully make a single real patient call.

What is a BAA and why does AI need one?
A Business Associate Agreement is a contract, required by HIPAA, between a covered entity and any vendor that handles protected health information. It obligates the vendor to safeguard that data. Any AI tool used on real patient information needs a signed BAA to be compliant; without one, the use is a violation.
Is ChatGPT or a general AI tool HIPAA compliant?
General consumer AI tools are usually not HIPAA compliant, because they do not sign a BAA for standard accounts and are not designed to safeguard PHI. Using them on real patient data is not compliant. A healthcare-specific platform that signs a BAA, like Rivvi, is required instead.
