Third-party marketing organization (TPMO)

A third-party marketing organization (TPMO) is an organization or individual paid to market or sell Medicare Advantage or Part D plans on a plan's behalf. Examples include agents, brokers, field marketing organizations, and call centers. CMS holds TPMOs to specific rules on disclaimers, call recording, consent to share data, and unsolicited contact.

What a TPMO is

CMS defines TPMOs broadly. It covers independent agents and brokers, field marketing organizations, call centers, and lead generators. All are paid to do marketing, sales, or enrollment work for a plan. The plan sponsor must oversee them. For contract year 2027, the rules apply to marketing that begins October 1, 2026, including a standard disclaimer said before any benefits discussion.

Marketing and sales calls must be recorded and kept for at least 6 years. Years 1 to 3 must be audio, and years 4 to 6 can be audio or a full transcript. TPMOs cannot cold call, robocall, text, or leave unsolicited voicemails. Sharing a beneficiary's data with another TPMO requires prior express written consent naming each recipient.

What is the TPMO disclaimer?
A TPMO that does not offer every plan in the area says: "We do not offer every plan available in your area. Currently we represent [#] organizations which offer [#] products in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options." The numbers are filled in for the caller's area.
What if a TPMO represents every plan in the area?
It uses the shorter version: "Currently we represent [#] organizations which offer [#] products in your area. You can always contact Medicare.gov or 1-800-MEDICARE for help with plan choices." Both versions are set out at 42 CFR 422.2267(e)(41).
When must the TPMO disclaimer be said?
For contract year 2027, it must be said verbally on sales calls before any discussion of benefits. The old rule to say it within the first minute was removed. So was the reference to State Health Insurance Assistance Programs. The disclaimer also appears in TPMO marketing materials and websites.
Can a TPMO cold call Medicare beneficiaries?
No. CMS bans telephone solicitation, robocalls, unsolicited texts and voicemails, social media direct messages, and door-to-door contact. Returning a call, or calling someone who asked for contact on a business reply card, is not unsolicited. Sharing that person's data with another TPMO requires their prior express written consent.
